CEBS organises a public hearing on its draft guidelines on liquidity cost benefit allocation
The Committee of European Banking Supervisors (CEBS) has published its consultation paper on draft guidelines on liquidity cost benefit allocation (CP36). The consultation is open to all interested parties, including supervised institutions and other market participants.
Following the publication of its
advice to the European Commission on Liquidity Risk Management in September 2008 and the amendments to the
Capital Requirements Directive issued in September 2009 (see the new Annex V) that call for “robust strategies, policies, processes and systems for the identification, measurement, management and monitoring of liquidity risk…” that “…shall also include adequate allocation mechanisms of liquidity cost, benefits and risks”, CEBS has committed to undertake further work on liquidity cost allocation.
The main objective of CEBS’s guidelines is to provide high-level guidance to the institutions on the main elements to be considered when creating or reviewing adequate fund allocation mechanisms including liquidity cost, benefits and risks. Thus, a liquidity cost concept that includes not only direct funding costs but also associated indirect costs such as liquidity contingency support is proposed.
CEBS submits its initial views for a public consultation which runs to 10 June 2010. Comments received will be published on CEBS’s website unless respondents request otherwise. Please send your comments to the following email address:

CEBS organises a public hearing on its draft guidelines on concentration risk (CP31)
The Committee of European Banking Supervisors (CEBS) has published its draft revised guidelines on aspects of the management of concentration risk under the supervisory review process. The consultation is open to all interested parties, including supervised institutions and other market participants.
The draft revised guidelines update the Guidelines on technical aspects of the management of concentration risk under the supervisory review process published on 14 December 2006 and complement the principles set out in the
CEBS’s Guidelines on the application of the supervisory review process (GL03).

CEBS organises a public hearing on its guidelines on the operational functioning of colleges (CP34)
The Committee of European Banking Supervisors (CEBS) has launched a consultation on its draft guidelines for the operational functioning of colleges. The consultation is open to all interested parties, including supervised institutions and other market participants.
The revised Capital Requirements Directive (CRD) requires the establishment of supervisory colleges as an instrument for stronger coordination and cooperation whereby competent authorities reach agreement on key supervisory tasks. The colleges are expected to facilitate the handling of ongoing supervision and also to play a role in both the preparation for and handling of emergency situations. This consultation paper responds to the requirements of the revised CRD according to which CEBS should elaborate guidelines for the operational functioning of colleges. In addition, the draft guidelines aim to complement the CRD provisions where additional guidance appears necessary in order to avoid inconsistencies and regulatory arbitrage, which could result from differences in the approaches and rules applied by the various colleges and the application of discretion by Member States.

CEBS organises a public hearing on its draft revised Guidelines on Stress Testing (CP32)
The Committee of European Banking Supervisors (CEBS) has published the draft of its revised Guidelines on stress testing for consultation. The consultation is open to all interested parties, including supervised institutions and other market participants.
The revised guidelines update the Guidelines on Technical Aspects of Stress Testing under the Supervisory Review Process that were published on 14 December 2006 and complement the principles set out in the
CEBS’s Guidelines on the Application of the Supervisory Review Process under Pillar 2.
The revised guidelines draw on the experience that supervisors have obtained by reviewing institutions’ stress tests in recent years, and take account of the
revised principles for sound stress testing practices and supervision published by the Basel Committee of Banking Supervision (BCBS).

CEBS organises a public hearing on its draft guidelines on the management of operational risk in market-related activities (CP35)
The Committee of European Banking Supervisors (CEBS) has launched a consultation on its draft guidelines on the management of operational risk in market-related activities. The consultation is open to all interested parties, including supervised institutions and other market participants.
Within the guidelines CEBS introduces more specific principles and implementation measures for the identification, assessment, control and monitoring of operational risk in market-related activities. CEBS draft principles are divided into three different parts, addressing the management of operational risk in market-related activities from three different angles:
• Governance mechanisms - principles 1-5;
• Internal controls - principles 6-15; and
• Internal reporting systems - principles 16-17.

CEBS organises a public hearing on its guidelines on instruments referred to in article 57(a) of the CRD (CP33)
In December 2009, the Committee of European Banking Supervisors (CEBS) published its consultation paper (CP33) on its implementation guidelines on capital instruments. The consultation is open to all interested parties, including supervised institutions and other market participants.
The revised Capital Requirements Directive (CRD) introduces explicit rules for the treatment of instruments eligible as capital and, in particular, requirements for their inclusion in institutions’ original own funds without limits. The amendments will need to be transposed into Member States’ national law by 31 October 2010 and will then be applied from 31 December 2010. This consultation paper is a response to Article 63a (6) of the revised CRD that requires CEBS to elaborate guidelines for the convergence of supervisory practices with regard to the instruments referred to in point (a) of Article 57.

CEBS Public hearing on its draft disclosure guidelines reflecting the lessons learnt from the financial crisis (CP 30)
The Committee of European Banking Supervisors (CEBS) organised a public hearing on 26 January 2010 at the CEBS premises in London from 10.30 to 12.30 to discuss the comments received during the consultation period of its draft disclosure guidelines reflecting the lessons learnt from the financial crisis. The event provided a platform for all commentators and other interested parties - including preparers, users and analysts - to discuss views expressed on the consultation paper (for which comments could be submitted until 15 January 2010).
